PEMENUHAN HAK JAMINAN SOSIAL TENAGA KERJA PADA PT. CELVINDO PUTRA MANDIRI DI KOTA BATAM

Abstract

The fulfillment of employment social security rights is a form of legal protection that must be provided to every worker as stipulated in Article 99 paragraph (1) of Law Number 13 of 2003 concerning Manpower. This research is based on the fact that there are still workers, particularly temporary workers or those with short periods of employment, who have not been registered in the employment social security program. The purpose of this study is to identify and analyze the implementation and the form of corporate responsibility in fulfilling workers' rights to social security at PT Celvindo Putra Mandiri in Batam City. This study employs a sociological approach. Primary data were obtained through interviews with company representatives, workers, and officers of BPJS Ketenagakerjaan, and were supported by questionnaires distributed to employees. The results indicate that the implementation of workers' social security rights at PT Celvindo Putra Mandiri has not been fully optimal, as evidenced by the fact that some workers have not been registered as participants in BPJS Ketenagakerjaan. The company's responsibility toward unregistered workers is carried out by providing medical treatment assistance and compensation benefits. Greater compliance by the company with its legal obligations, more intensive supervision by relevant authorities, and increased workers' awareness of their rights are necessary to ensure optimal labor protection.
